These Terms & Conditions ("Terms") govern your use of instamate.app and all related services (collectively, the "Service") operated by Instamate ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms.
1. Service Description
Instamate is an AI-powered collision repair platform providing two core services:
- Consumer portal: free AI-generated damage estimates and referrals to licensed collision repair shops
- Shop portal: subscription-based operations software for collision repair shops, including job management, document generation, AI-assisted estimating, and customer communication tools
2. Estimates Are for Reference Only
AI-generated estimates produced by Instamate are for informational and reference purposes only. They are not insurance-approved estimates, not certified repair assessments, and not a guarantee of repair cost.
Actual repair costs may vary significantly based on hidden damage, parts availability, labor rates, and insurer negotiations. Always obtain a written estimate from a licensed repair facility before authorizing repairs. Instamate is not responsible for discrepancies between AI estimates and final repair costs.
3. Shop Subscription Terms
- Billing: shop subscriptions are billed monthly in advance via Stripe. Your subscription renews automatically on the same calendar day each month.
- Cancellation: you may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused days.
- Free trial: if a free trial is offered, it converts automatically to a paid subscription at the end of the trial unless cancelled beforehand.
- Price changes: we will provide at least 30 days' notice before changing subscription pricing. Continued use after the notice period constitutes acceptance of the new price.
- Refunds: all fees are non-refundable except as required by applicable law or expressly stated in a separate agreement.
4. SMS Terms
By using our shop referral service or signing a repair authorization form, you consent to receive SMS messages from Instamate related to your estimate, referral status, and repair job updates.
- Opt-out: reply STOP to any message to unsubscribe. You will receive a single confirmation message and no further SMS will be sent.
- Help: reply HELP for assistance, or email [email protected].
- Message and data rates may apply. Check with your mobile carrier.
- Message frequency: varies based on platform activity; typically 2–6 messages per repair job.
- Carriers are not liable for delayed or undelivered messages.
- SMS consent is not a condition of purchase. You may use our platform without consenting to SMS by not requesting a shop referral.
5. User Responsibilities
By using the Service you agree to:
- Provide accurate, complete, and truthful information about yourself, your vehicle, and the damage
- Not use the Service to submit fraudulent insurance claims or misrepresent vehicle damage
- Not use the Service to harass, spam, or send unsolicited communications to repair shops or other users
- Not attempt to reverse-engineer, scrape, or abuse the Service or its AI models
- Comply with all applicable federal, state, and local laws
- Keep your account credentials secure and notify us immediately of unauthorized access
6. Intellectual Property
All content, software, trademarks, and materials on the Service are owned by or licensed to Instamate. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. Estimates and documents generated for your shop or estimate are licensed to you for personal and business use only.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTAMATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless Instamate and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may revise these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
